General Terms and Conditions (GTC)
Age Restriction
The use of the online shop and the placing of orders for products subject to a legal age restriction is reserved exclusively for persons who have reached the age of 18.
TradeSpot Digital AG is entitled to reject or not execute orders if there are indications of irregularities or misuse of the ordering system.
1. Scope and Content of the Contract
TradeSpot Digital AG operates the online shop at www.snuskingdom.ch and offers the products displayed there exclusively to private end customers residing in Switzerland or the Principality of Liechtenstein (hereinafter referred to as the “Customer”).
These General Terms and Conditions govern all contractual relationships between TradeSpot Digital AG and the Customer.
2. Conclusion of the Contract
A binding contract is only concluded once the Customer places an order via the online shop and this order is accepted by TradeSpot Digital AG.
Acceptance takes place either by sending an order confirmation by email or by dispatching the ordered goods.
3. Product Presentation
The product information contained in the online shop serves as a general description and is not binding.
Deviations in images, descriptions or price information as well as obvious errors are expressly reserved.
4. Prices and Payment Terms
All prices are stated in Swiss francs (CHF) and include the statutory value-added tax of 8.1% as well as all applicable customs duties and tobacco taxes.
No additional fees are generally charged.
For small orders with only a few items, a quantity-dependent transport surcharge is charged, the amount of which is displayed in the shopping cart.
TradeSpot Digital AG reserves the right to restrict certain payment methods and to execute deliveries, including to existing customers, only against advance payment, via TWINT or by credit card.
Price and cost adjustments remain reserved at any time. In the event of obvious typographical, printing or calculation errors, TradeSpot Digital AG is entitled to withdraw from the contract.
The payment option Invoice (including payment in installments) is operated by CembraPay AG. The T&C and the Data Privacy Policy of CembraPay AG apply.
5. Delivery and Shipping
Provided that the ordered products are available, dispatch usually takes place within one working day if the order is received by no later than 16:30.
Delivery is made to the address provided by the Customer.
The transfer of risk takes place when the goods are handed over to the transport service provider, including in the case of partial deliveries.
Transport damage that is externally visible can only be claimed upon presentation of confirmation from the carrier.
Delivery delays, in particular due to overloads in postal traffic, remain reserved.
6. Retention of Title
The delivered goods remain the property of TradeSpot Digital AG until all outstanding claims have been paid in full.
TradeSpot Digital AG is entitled to have a retention of title registered.
In the event of default in payment, TradeSpot Digital AG is entitled to withdraw from the contract and demand the return of the goods.
7. Right of Withdrawal and Return
For accessory items, there is a right of withdrawal of 14 working days from receipt of the goods.
Withdrawal is excluded for snus, vape and snuff products, as these are perishable goods with a limited shelf life.
8. Subscriptions
Subscriptions can be paused or terminated at any time via the customer account or by email to shop@snuskingdom.ch.
The change takes effect immediately and prevents future deliveries. Orders that have already been triggered remain unaffected by the cancellation.
9. Intellectual Property Rights
All content on www.snuskingdom.ch, in particular texts, designs, graphics and logos, is protected by copyright and is the property of TradeSpot Digital AG or the respective rights holders.
Use is permitted exclusively within the scope of the ordering process. Third-party rights remain unaffected.
10. Data Protection
Personal data is processed in compliance with the applicable data protection regulations of Switzerland.
Data is used exclusively for contract processing and internal purposes and is only passed on to third parties where this is necessary for the fulfilment of the contract.
The Customer has the right at any time to obtain information about the data stored about them.
11. Applicable Law and Place of Jurisdiction
All contractual relationships are governed exclusively by Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
The exclusive place of jurisdiction is Basel.
12. Final Provisions
The version of these GTC valid at the time the contract is concluded shall apply.
Any deviating terms and conditions of the Customer shall not apply.
TradeSpot Digital AG reserves the right to amend these GTC at any time.
Disclaimer
1. Content of the Online Offer
TradeSpot Digital AG assumes no liability for the accuracy, completeness or timeliness of the information provided.
Liability for material or immaterial damage resulting from the use or non-use of the content is excluded, unless intentional or grossly negligent conduct is present.
All offers are non-binding and may be changed or discontinued at any time without prior notice.
2. External Links
TradeSpot Digital AG assumes no responsibility for the content of external websites to which reference is made.
At the time of linking, no unlawful content was apparent. TradeSpot Digital AG has no influence over subsequent changes.
The respective website operator is solely liable for any damage resulting from the use of external content.
3. Copyright and Trademark Rights
TradeSpot Digital AG respects all copyright and trademark rights.
All brands and trademarks mentioned are subject to the rights of their respective owners.
Any further use of content requires prior written consent.
4. Compliance with Tobacco Legislation
Orders for items subject to a legal age restriction are permitted exclusively for persons of legal age.
By placing an order, the Customer confirms that they are at least 18 years old and will not resell tobacco products.
TradeSpot Digital AG reserves the right to reject orders in cases of suspected misuse and assumes no liability for violations of legal requirements.
5. Severability Clause
Should individual provisions of this disclaimer be invalid or incomplete, the validity of the remaining provisions shall remain unaffected.
